FWIW, when I went through this after being rear ended and totaled 
by an uninsured driver, it cost me my deductable at first, BUT AFTER 
ONE YEAR MY INSURANCE COMPANY REFUNDED IT!  This point is still not 
generally understood by the public ... and this list. If you're not 
at fault, your insurance company has the right/responsibility to 
pursue whoever is and get reimbursed for their costs, WHICH INCLUDES 
YOUR DEDUCTABLE. Whether they actually do is their choice, but either 
way, they owe you that deductable back. YOU ARE NOT FINANCIALLY 
LIABLE FOR THEIR CHOICE OR INABILITY TO COLLECT FROM WHOEVER IS AT 
FAULT, so don't act like you are. Ask your insurance company when 
you can expect your deductable refunded to you. For me it was one 
year. 

Before you spend on a lawyer, call your state's Dept of Insurance 
and get their opinion ... and take notes so you can use them as 
a reference if necessary in negotiations with your insurance co.

Well, if the structure that collapsed was rented, perhaps the owner 
of the apartment has some liability; I'd bet he'd kick in the deductable 
at a minimum, especially if approached by a lawyer.
