Even on the track, the only time I've ever had the ESP intervene despite
being switched "off" was under braking. The ESP documentation in Bentley
indicates that the "off" switch on the dash is overridden by the
application of the brakes.

Though I haven't purposely pushed the car beyond the limits in the dry or
wet with the ESP "off", I have done so many times in the snow, and even
then didn't get any intervention unless I was on the brakes. Drove
sideways for the better part of a city block, too :)
