I would suggest:

Get and estimate for muffler & installation from your local dealer or other
reputable installer - you want Original Equipment installed.

Insist he overnight you a money order immediatly for the amount, probably
around $600.

If you don't see the $$ tommorrow, call you Insurance Co.   They will handle
this, and you will hopefully get your check in short order.

Make sure the Ins. Co knows that you had called for police, but they didn't
show up and it was in the middle of a snowstorm.  

The fact you have the guys rental info and lic. should be enough for them to
trace that there was an accident, the KIA damaged in front, The Q in the
rear.  It becomes obvious who is at fault.

Hey, I wouldn't have been nice!  I _tried_ to get the effing cops to show
up, but they were "too busy" which sounds like a load of BS.  The very next
morning I heard in the local paper that the police had no reports of
accidents from that night in our area.  :(  Lazy bastards...and me, with a
fiance who is part of the police and patrolman's union!  I just don't want
to pay my $500 deductable.

He's insured in Chicago, and barely spoke any english.  He gave me a copy
of the rental agreement, his phone #, drivers license #, etc.  He declined
all of the insurace at the rental agency.  The guy was just plain
clueless...he almost got hit by a snow plow while walking across the
street.  As in, stepped in front and I had to pull him back before he got
killed.  From the damage on the Kia, its pretty obviouis he was in the
wrong, so if he gives me any problems, I'll just sick State Farm on the
poor bastard.  It doesn't help that my insurance is in michigan, his
personal insurance is a small company in Chicago and the accident happened
in MA in a MA rental car.  Plus, the cops were too busy to show up.  Kind
of muddies the water.  

Does anyone know how this works?  I'll call him and ask him for $600 for an
exhaust system.  If he complains, then I'll deal with insurance companies.
I just have no idea how massachusetts insurance laws works...
