Even if the Police do not come (they usually WILL NOT unless there is
personal injury or suspected criminal activity involved) you should go to
the nearest Police Station and fill out an incident report.  This
incident report will be the basis for all further action by the insurance
company, especially here in Massachusetts.  There is a time limit, a
generous one, for filing these incident reports with the police, so you
still might be able to file.  One copy goes to the registry I believe.
The rental car HAD  liability insurance or it wouldn't be allowed to
prowl the highways and byways of the Commonwealth, it's all a matter of
proving fault, period.
