How can I tell if my 98 A6 Avant is a 30v or 12v????

CarFax isn't known for being really accurate.  That wouldn't be the first
thing they were wrong about.  If your are still wary, another difference is
the side the oil *cap* is on....12v - passenger side, 30v - drivers side (US
cars).

You do have a recourse IF you can show that the dealer purposely
misrepresented the car.  If you just "heard-what-you-wanted" (as I have done
in the past) because you thought it had a 30v than you don't have any
recourse!!  It may be hard to prove!!

No tiptronic.  How do you explain why the VIN comes back as a 30V?
Damn, I paid a huge premium over a 96 A6 just so I could get the 30V.
Do I have a recourse against the dealer?
