Wouldn't the simplest thing to figure this out be getting the speed
limit, distance to road closed sign when it becomes readable (given
good eyesight and sobriety :), reaction time, stop time. It seems as
posted that there were 100 feet between the sign and the berm, so how
many feet before the sign was it readable? If you were unable to stop
in the required distance given your speed if you were within the
limit, then you would have a good defence. For this you would have to
do a little research of course.
