I'm very sorry to hear about your accident.

Do not under ANY circumstances deal directly with this person -- unless of course he is willing to give you a check for $1,000,000.00.

It's one thing to deal with an individual when it is an extremely minor accident, but given the extent of the damage and the possibility of medical problems beyond the initial muscle spasms / soreness that will most likely go away in a few days you need to to the following.

Report this to YOUR insurance company -- you do not necessarily have to put a claim in with your insurance company, but you must report this incident to them to protect you in the event that things do not go well in the future.

You can put a claim in against HIS insurance company, which you will have to do in the event that you do not maintain collision coverage on you car.  You need to let them know that you would like to resolve things in a fair and equitable manner, but you have no intention of being taken advantage of, and if you feel that you are not being treated in this manner you will seek the services of an attorney.
