No California law states that the vehicle emissions must adhear to the latest addembly. If you stick and engine from an 01 1.8t into a 78 rabbit, you must meet 01 standards. If you stick a 91 V8 engine in a 02 TT, you must meet 02 emissions.

There is no law out there (that I'm aware of) which says you must use something offered by the oem.
