Michigan does to, maybe even more extreme testing of this water, looking at 
possible "intent" to enter a public roadway, but not actually entering it.  I 
remember intently reading a case in a local northern MI paper a couple years 
ago where a man was convicted of drunk driving even tho he stopped short of the 
public roadway (at the end of his driveway when he saw the cop).

NH - where every case appears to be both precedent and non-binding, recorded 
or not.
