The state of Michigan's policy is:
1. you have to prove where it happened
2. You have to report it to your insurance company first (if you don't
submit it to your insurance company they will automaticly deny it. And
then if there is any unpaid expense they'll look into it.
BUT anytime you hit something on the road that isn't moving, (which
includes potholes, boards, etc) it is considered an at fault accident
by the insurance companies and as such can increase your insurance
premium.
So basicly while driving on our connectted potholes we call roads watch
out because it's driver beware! If you hit a pothole and wreck your car
and feel it was impossible to miss document it with photographs because
your insurance company will list it as an at fault accident.
Don't ask me how I know all this sad information....
