[s-cars] The truth about a FMIC "scam" accusation.

Yesterday, on Audiworld (AW), a lister from here (Audifans) who also
posts on AW, accused me of "scamming" Tom M. and Marc S. when I
bought one of their first FMIC kits last June. I reported this slander to the
AW mods who nuked the posting. I then started an email discussion with
the person who made the post.

Supposedly, the "scam" was based on me receiving a damaged intercooler
core from Tom and Marc, getting a second (undamaged) core from Tom
and Marc and then a) refusing to sign a UPS damage claim so Tom and
Marc would not be out of pocket and b) then never returning damaged
core to Tom and Marc and using it for my benefit. The person who made
the accusation says he heard this from another lister (who I also
contacted) who says he heard it from another lister (whose name he
wouldn't provide).

The truth is that I did receive a damaged intercooler core. It had been
dropped and one of the end tanks bent while in its own box somewhere
between Taiwan and Tom and Marc. Tom and Marc had not opened the
IC box before they shipped it to me so they had no idea it was damaged.
Tom and Marc did an excellant job of packing the IC and the piping and
their large shipping box was undamaged when I received it from UPS. As
a result, although I was asked to sign a UPS claim, I could not do that
because it would have been fraud. The problem was with Tom and Marc's
supplier. This is where my accuser claims that I ripped off Tom amd Marc,
"the little guys, just trying to make a buck" by not defrauding UPS.

After I received the second core, I sent the original bent IC core back to
Tom. That was the end of the story until yesterday.

I have contacted my accuser, the person that told him the story and Tom
and Marc. Tom is on holiday but did provide the following:

"Guys,

Sorry for the delayed response. I am just now reading this as I am on
vacation. Internet access here is slow and pricey, so let me be brief:

Dave is correct. He received a damaged core. We shipped another. He
shipped the damaged core back. He decided that the core was damaged
before it was shipped and elected not to fill out any damage claim
paperwork. The end.

As I haven't read all the related BS please forgive me if I am missing
something here. I will send this despite my reservations about providing
details of a personal transaction to a third party. As far as I am
concerned, this discussion is over.

Regards,

Tom"

I have asked my accuser for a public apology. The response was a string
of colourful expletives not heard since recent re-runs of "Deadwood" on
HBO. When I contacted the person who told my accuser the "scam" story
"as he heard it" (from persons unnamed), I was told that I was a
"Stanley" (which I take to be a "tool") and that I should "get over it".

I think somebody started a nasty rumour and a couple of listers with big
mouths perpetrated this rumour to the point of slander. I obviously am
not able to let it go without at least trying to clear my name.

I trust that anyone who may have heard this rumour from someone will
now understand that there was no "scam" and that I was completely
honest in the whole thing. Too honest for some people apparently.
