Mark,
Boy, if it was me in that situation I would have filed a complaint about
said pothole and then mysteriously 3 days later I would have hit said
pothole causing damage.....what are the odds? :)

Several winters ago my mother hit a pothole on the very right hand side of
the lane, while driver her BMW 330xi. This pothole was deep, and I was
avoiding it daily. Anyhow, it bent two of her winter rims. I ordered 2 new
rims and Nokians. Steamed over her stupidity (pay attention!) and the fact
the county didn't do any repairs as of yet, I called them. Here's the basic
rundown of the conversation, which was all nice:
Me: There's a very deep pothole that is months old on County Route 32,
about a mile from the village limits. We had damage to our tires because of
this. What is the normal procedure for filing a claim?
Superintendent: Well, you can only file a claim if we've been notified
about the pothole previously.
Me: Have you been notified about this one?
Superintendent: No, but I have records about other potholes on Rt. 32.
We'll be getting to them in about a month.
Me: Oh, can I review those records?
Superintendent: No, I don't write them down.
Me: So if there's no log, the only way anyone could file a claim is if they
notified you in writing before hand, gave you time to repair the problem,
then came into contact with the same problem?
Superintendent (laughing): Yes, that's why we've never had a claim.
Me: Gotcha.. well, we do use the road daily, so if you can get on it ASAP,
that would be appreciated.
Superintendent: Will do. Have a good one!
It was totally amicable... but amusing how an old highway superintendent
(he's been doing the job for like 40 years) makes his own bureaucracy.
I'd imagine with a state it might be different.... but I wouldn't hold my
breath for compensation. Good luck!
