Not so fast. If Subie is like Audi, they set aside a certain amount of money each year to each dealer for "discretionary" repairs. Things that might not be exactly covered under the warranty but common sense dictates it's not something that should break after a limited # of miles or age or what have you. The thing to do is to rationally, yet sternly and steadily go up the chain of command at the dealer, all the way to the GM or dealer principal. If that amounts to a dead end, then the manufacturer has a regional suit that is assigned to monitor/approve warranty repairs. He needs to find out who that person is and contact him/her, or demand the Service Manager at his dealer arrange for a meeting with that person and himself. I had a similar issue with the radiator on our allroad. The car was still under CPO warranty, and the radiator sprang a leak. I took it in, and they said the leak was caused by previous body damage as a result of a front-end collision. The collision was not during my ownership, and they couldn't prove that it didn't happen before Audi certified the car, so my position was they should stand behind it and live up to their end of the deal. Ultimately we settled for splitting it 3 ways me/dealer/Audi.
$400 is still better than $1200.
