Abe, 

I found this site which lists alot of Vermont auto insurance laws, the one that 
grabbed my attention is:

"The cost of repairing or replacing your car after an accident, regardless of 
who was driving or who was at fault. Payment is limited to your car´s actual 
cash value, minus your deductible. Actual cash value is the market value of a 
car like yours before it was damaged."

However there may be a percentage of the car's actual value that your insurer 
can total it out, provided it's in your contract, here is some
information I found on Progressive's website regarding totaling a car out.

This  Copy n Paste from their website leads me to believe there should be no 
magical percentage in your case.
"Is there a pre-determined threshold that's used when deciding if a vehicle is a 
total loss — for example, if the cost to repair a vehicle reaches a certain 
percentage of the ACV?
No, except in states that mandate or set specific thresholds."
 
FYI treat Progressive's initial "findings" as an offer, everything is up to 
negotiation.

Subject: [s-cars] Rearended

Fellas.  Got rearended in the s6 this morning on way to work.  I am fine,
rear bumper is damaged and right rear quarter panel is slightly damaged.
The other guy 100 percent at fault.  His insurance, progressive, coming to
look at car Monday.  Based on age and availability of parts he said could be
a total.  Can you folks give me some recent sales prices for 95.5 s6 avant
on the off chance they total it and lowball me?
