Why debate it.  Just go and try it yourself.
Apply full throttle, wait a second to simulate the real world where you
might not know what happened, then step on the brakes.
See what happens.

The real world trouble will be the case where you were doing something
reckless to begin with.
If you are riding too close or already going too fast, then there could
be a problem.

The person who had the time to make a phone call is either a liar or a
moron.
