Depending on the paint type, that could be to allow space for tinting. 
But, it seems the manufacturers will do whatever they can to make it work in their 
favour. We used to get paint in CDN gallons (4.55 liters or so), but now, instead of 
making it an even 4 liters like most other things, we see the equivalent of a US gallon 
(3.8 liters or so). Some cans are even less, 3.7 liters, to allow for tinting. Clear base 
paints are usually the worst, as they require a *lot* of tint.
