From what I recall, it's not that you can't but you have to meet the body's emission standards thus making it "difficult" to put an older engine in a newer car. Seems like in WA State, once the car is 7 or 10 years old, it's not exempt but less scrutinized.

You need to check the EPA regs. My hazy recollection is that you can put a
ewer engine in an older car, but you can't put an older engine in a newer

I have found a 93 passat wagon that has the v6 5 speed trans. i would like
to swap in a 91 jetta td, 1.6 motortrans. it appears that the engine/trans
mounts are in the right position. also i thought i would use the jetta
axles.
because it is the v6, it has the 5 lug wheels.
