You know I hate doing research for my clients.  You guys have forced my hand
so here is the research for the Q List!  I can't speak to DOT or NHTSA, BUT
there is still a class action pending against VW b/c of the UA issue.  In
Perona v. Volkswagen of America, 292 Ill. App. 3d 59, 684 N.E.2d 859 (1st.
Dist. 1997) the Illinois Appellate Court knocked out a bunch of counts found
in the suit but held that the owners adequately alleged a consumer fraud
violation based on material omission as to sudden acceleration problem, but
such claim was limited to vehicles purchased before defendants issued press
releases acknowledging existence of excessive unintended accelerations.

I don't want to get too technical.  The above is a very brief synopsis of a
10 page decision (I can send the entire decision to anyone who wants it via
e-mail).  In a nutshell, the decision means the suit can proceed on the
consumer fraud action only.  The plaintiffs have had a terrible time just
properly pleading their action (this case refers to a fifth amended
complaint).  The decision doesn't mean that the cars actually suffered the
problem or that Audi was in the wrong.  FWIW, VW is being represented by
probably the best power litigation firm in Chicago.
