continuing saga...
Phil asks of the legal aspects in the ol' US of A.
Notes are fine, but a person can and probably will deny handwritten
notes unless he has signed them, or [fat chance] he has written the
notes. If the conversation is important, one can simply take out a
tape recorder, place it on the table in plain view, and tell the
person you are speaking with that you would like his permission to
record the coversation. Obviously, it is for his benefit and yours,
as it will eliminate any chance of error, lapse of memory, etc.
Provide him with a copy or a transcript later. If he refuses the
request...well...[I am mindful that this is the internet. :) ]
Remember, it is a crime in some states to record conversations without

While I am unsure of the underlying facts of this thread, rest
assured, any "continuing saga" is a pita. Most people that screw you
assume you won't waste the time taking it to court, and, given the
costs, many of those people are right. The ones who assume
incorrectly, well....they were wrong twice, no?

Btw, just so people don't complain that I am pushing for more
litigation, know that I am open to alternative dispute resolution,
which is sweeping the country. Well, actually I prefer resolution
[with consent of all, of course] via Dog Brothers rules, but that is
a different thread. :)
