I sure hate to burst this bubble, but in recent actions the Montana Supreme
Court declared the "reasonable and prudent" speed limit unconstitutionally
vague and the Montana legislature has enacted or is enacting a 75 mph
maximum limit virtually as we speak. The door is closed.
The critical case came before the Court when a one-time stock car
racer - a local yokel - was apprehended doing 130 something mph. His
argument that his race experience met the reasonable and prudent criterion
failed to impress the Court. In a companion case, the Court found that this
same gentleman could be convicted for reckless endangerment.
