california smog impact fee




	i know *i* had to pay the $300 for my urq last
	year.  this is good news, and looks legit.

Did you bring you car in from out of state and fork over $300 for a smog
impact fee? The $300 smog fee paid to DMV when registering a car in
California (after September 1992) was recently declared unconstitutional
and will be refunded -- but ONLY IF YOU ASK FOR IT. As far as I can tell
this looks pretty legit. Read on and good luck...



"In 1994, several new residents of California recognized the unfairness of
being charged a $300 "Smog Impact Fee" in order to register their used
vehicles in the State, when existing residents did not have to pay $300 to
register their used vehicles, even though both vehicles passed the same
smog test.  After asking for, and being denied, refunds by the State Board
of Equalization and the Department of Motor Vehicles, these residents filed
a lawsuit against the State of California seeking refunds, plus interest.
This bitterly fought lawsuit has been going on for several years, and in
October 1999, the California Court of Appeal, Third Appellate District,
held that the Smog Impact Fee was unconsitutional.

Despite this ruling, the State has refused to notify persons who paid the
Smog Impact Fee of their potential right to a refund.  We are the attorneys
for the citizens who filed this lawsuit.  This site is being made available
to you because, if the court's ruling is upheld on appeal, you may be
entitled to a refund of the $300 you paid, plus interest, but only if you
file a timely refund claim."
