I just have no idea how massachusetts insurance laws works...
None of this makes any difference.
1. Your Michigan insurance company has offices in Massachusetts. They can
handle it, if you choose to go that route. Of course, you probably have a
deductible.
2. In Massachusetts, liability insurance is mandatory. The rental car
company is required by law to have liability insurance on this car.
Liability insurance is to protect them and the renter from claims by you for
accidents in which they are at fault. If he was renting that car legally,
there is insurance on it. Making a successful claim is another story. It
is an adverserial situation.
3. When he declined the "insurance" at the rental car counter, he was
declining insurance that would cover him against damage he did to the rental
car. You don't care about that.
4. It was a bad snowstorm that night. There were accidents all over the
place. 128, for example, was littered with disabled and damaged cars.
You're right. The cops thought your accident was no big deal.
