How can I tell if my 98 A6 Avant is a 30v or 12v????

Don't take Carfax as gospel.  They are not correct in this case, and
are just as confused as you apparently are about the '98 A6 sedan vs. Avant.

Recourse against dealer?  I doubt it unless they explicitly misrepresented
that fact, and you have that in writing or something.  You paid a premium
because you got a car that's two years newer, not because of any engine
differences.
