I'm not so sure I agree that the guy is due a refund. Let's say I put up for sale on e-bay some "Audi 4000 brakes". A guy buys them for $100. When he gets them he says hey these aren't Audi 4000 Quattro brakes! I want a refund. Is he due one? I don't think so, I sold him Audi 4000 brakes. He didn't ask if they were brakes from a 4KQ, nor did I sate they were.
In this case, if I understand correctly, the brakes were "Skyline" brakes. Right? It is the sellers fault the buyer ASSUMED that they were the upgraded "Skyline GTR" brakes? Remember, never assume, it makes as ASS out of U and ME.

Agree, and would add that the goods were misrepresented, PERIOD. Any
ambiguities in the description are weighted against the guy who wrote it,
not the guy who read it. Keeping the guys money, and the shipping
charges would be a sleazebag thing to do IMHO, and the buyer is 100%
within his rights to receive both back from the seller. If seller blew
the cash on something else that's not the buyers problem, and frankly
quite an irresponsible thing to do. I couldn't get the link to work, so
I don't know how much $ we're talking about here, it's irrelevant anyway,
right is right.

He technically didn't threaten anyone either, playing by the sellers own
"shyster speak" rules.
