Rob,
Would the SEMA judgements mean anything in a Quebec, Canada court under The
Civil Code of Quebec?  Although I'm no lawyer, I do believe there's a
different burden of proof there.  In fact, there's an entire chapter on it
in "Law for Professional Engineers" (Marston), including a paragraph
entitled "Presumption of Liability" - which basically says that if a
building falls down, the owner can "rely on this presumption of liability,
the architect, engineer, contractor, and subcontractor have the burden of
proving that they commissioned no fault, or that the defects result from a
decision imposed by the client".  Anthony (assumed to be living in,or in the
vicinity of, Ste-Dorothée, Laval, Quebec) might find the outcome of a Quebec
Civil Court case to be in Audi's favour.
Scary, huh?
