OK, so here is the answer from Accel warranty on why my TPS is not a covere=
d item. Does this sound accurate to everyone/anyone?

Thanks!

Hi Mr. Mendel. I heard back from my contact, and he said this is what he f=
ound out:

The TPS is actually an emissions component. It's only purpose is to contro=
l the amount of gas & smoke that goes in the air. Although it is located i=
n the fuel injection system, it is an emissions component, just like the ca=
talytic converter is located in the muffler, it's still an emissions compon=
ent. He said if you were to take your vehicle to an Audi dealer and it was=
still under manufacturer's warranty, Audi would file the claim under the e=
missions classification. This component is on the vehicle solely to be com=
pliant with emissions laws in the U.S.

I know this is not what you wanted to hear, but this is the final answer. =
I am glad, however, that the other $802 was covered for your vehicle. If t=
here is anything else I can help you with or other questions I can answer, =
please do not hesitate to contact me. That's what I'm here for. Thanks, a=
nd have a great day!!

On my current open claim, all is fine except for one =
item, the Throttle Position Sensor (TPS) that I menti=
oned in my previous email.

My position, and my mechanic John's as well (he's a Bosch certified master =
mechanic), is that the TPS is a fuel injection sensor. Heritage's position =
is that the TPS is in the emissions area, and is therefore not covered. In =
fact, in speaking with them, John told me that Heritage feels that every se=
nsor in the fuel system is actually for emissions, so they really don't cov=
er anything. So their listing of covered items in the "fuel injection senso=
r" area is misleading at best, since every time you call them they'll most =
likely say "Oh, that's an emissions item". Needless to say, John and I are =
not happy with that.

So I did some research, speaking with Audi of America, and getting the offi=
cial Bentley/Audi factory service manual for my car. The TPS is considered =
by Audi to be a fuel injection sensor, which is specifically covered in the=
"covered items" section of my warranty.

In fact, I have the factory manual now, and the TPS is listed and described=
in section J24, under the index heading of "Fuel Injection and Ignition, 2=
.22 Liter 5-Cylinder Turbo", which is my car's engine. If you'd like, I can=
 fax you the page.

Can you intercede, or let me know what the appeals process is?

Thanks!

Bruce Mendel
