In NC, they must test the car, as equipped.

My S4 is OBDI and is not tested.
My plans to get my wife a 97 S6 would have caused a
problem.  Discussions with the NC Division of Air
Quality (the implementer of this rule) said if I had
the paperwork where the car was legally imported from
Canada, and presented this to NC Department of Motor
Vehicles office with proof of OBD I, then I could get
a wavier from emission testing (but not a waiver from
the visual inspection of presence of emission
equipment).
