IANAL, but a sharp prosecuting attorney could argue that
a) you disabled a government (via the EPA) mandated control,
and b) in doing so, you tampered with evidence.

Just saying, from my limited knowledge of black boxes being
used to prosecute drivers.

Me?  I'd be happy with a '93 V8 and a 95.5 S6 Avant.
