They are already there, at least on some GM cars. My take
on it, and I am by no means an expert, is that the engine
management black box that determines engine, road speed,
and gear selection, combined with whatever ABS black box
there is that determines if the brakes are being applied
(and possibly how hard they are being applied) work as
normal. Since all that data is there, the manufacturers
decided to record it, to capture real world data that
they can upload at the dealership. But as a by product,
that data is also there so a prosecuting attorney can
gather evidence.
