My $.02 on this subject.
Here in WV I was clocked doing 78 in a 50 by a state trooper, on a 2
lane road. I knew I was in the wrong and immediately pulled over.
Used the yes sirs/no sirs and told him I knew I was speeding b/c I was
late for a meeting with the owner of the company I work for (which was
true) and a client. He was cool and wrote me up the ticket very
quickly and let me go on my way.
I went to court with no lawyer just to try and get the points reduced
as 25 and over is like 6 pts instead of 2 and carries a "reckless
driving" component, or something like that. So, its my turn before
the judge...the Prosecutor and the state trooper are there..I plead my
case, told them I was guilty of speeding but could they have
consideration on the points etc...the prosecutor is adamant that I get
no leniency, she was quite the bitch about it. The trooper looks at
her like WTF? and then stands up and says to the judge that I was
polite and respectful and he has no problem dropping the points and
reckless charge....which drew the coldest stare I have ever seen from
a woman (prosecutor) and again the DA declines to withdraw the points.
At this point people in the courtroom start perking up b/c the judge
starts drilling the DA why she is so adamant about not dropping the
points since I made my plea and the S.T. supported my effort. She
starts rambling on about how people today get away with too much blah,
blah blah....
In the end the judge dropped the points and the reckless charge while
almost scolding the D.A. for being such a bitch in so many
words.....it was the best courtroom experience ever.
I thanked the judge and State boy on my way out and gave a quick smile
to the DA.
Even though I paid up nearly $200 it felt like a complete victory.
