Since many V8s end up in the parts yard due to expensive
mechanical issues (broken t-belt, dead transmission), you
should be able to find a knee bolster in good shape. The
one in there was 10+ years old and you never worried about
it; why worry about the "new" one?
IANAL, but I would think if the part failed in an accident,
the body shop (for doing the work) or insurance company (for
approving a used part) could be held liable.
I'd get a used bolster and not worry about it.
