Relief appears to be forthcoming. SB267, introduced by minority leader
Frank Watson, was read on the floor last week. After passing through the
Rules Committee, it was assigned to the Revenue Committee, which gave it a
Do Pass recommendation yesterday. Passage through the Revenue Committee
indicates bipartisan support, and good prospects for a positive outcome in
the Senate. Second Reading, which takes place before the full Senate, is
scheduled for this coming Tuesday. There may be a delay of a day or so in
order to let co-sponsors sign on. Apparently, there's a move afoot to
introduce companion legislation in the House, although passage there often
takes longer due to the volume of legislation introduced there. Here's the
bill summary from the General Assembly's website:
>Amends the Motor Fuel Tax Law. Provides that the term "blending" does not
include the conversion of cooking oil, used restaurant fryer oil, or any
other similar oil into motor fuel for ones personal, noncommercial use.
Effective immediately.<
I've not had time yet to study the full text, but the synopsis would
make it seem that the amendment would obviate the need for gathering and
paying for the permits as these folks were told to do.
It appears that the incident resulted from overly zealous revenuers
enforcing strictly an area of revenue code that technology had rendered a
grey area. Decatur, IL, where the folks live, also happens to be the home of
Archer Daniels Midland, in case anyone is keeping track of coincidences. :)
