Need Advice on Recall Issue (Transmission)



Subject:  1990 80, 95k miles

Problem: When cold (after sitting overnight) transmission refuses to
upshift. After about 1/2 mile of 10mph at 4-5k rpms it loosens up and shifts
fine. After my *non-dealer* mechanic changed tranny fluid, added  new pan
gasket the problem persists. He says the problem is almost surely the diff.
oil leaking into trans. reservoir - subject of a recall ( which I think has
been discussed on the list sometime past ).

1) AoA says dealer has to look at it first to determine whether or not it is
recall  material.  $
2) Dealer says even if the problem  *is* recall based they most likely won't
cover it (90% chance)! $$
3) Factory exchange transmission is $2800, plus I'd have to rent one of
their cars (only $30/day) for the 4-5 days they are working on it. $$$.
4) This is the dealer in San Antonio (1 1/2 hours away), because they have a
good reputation, whereas I wouldn't even let the local dealer change my oil
- even if they loaned me an S4 for the day!

Can you spot a trend here?  As much as I want a new A4, thie timing just
isn't good.

What I really need is some good advice.  TIA,
