those details can be quite a PITA.  last september, the other person refused
to accept liability, and his insurance company doesn't give a flying *&^
(wouldn't even bother to look at my car).  my insurance company doesn't
fault me (and so far hasn't raised my premium), in fact sent him and his
insurance company a nice note pointing out the law, but i'm still out my
deductible.

i won't touch this any farther than to say that's probably why all of us pay
more than we need to for insurance.
