1 point mover ( failure to keep right etc.)Reduction of the speed from
25
over to 15 over is a two point reduction (5 > 3).Since the judge/jp
doesn't lower the fine it's no skin of the muni's nose, revenue is the
same. The rpo doesn't loose his quota points so he won't care.
Just remember the advice "don't fight your battle on the side of the
road".
If you plead "not guilty",and it's the rpo's granny's birthday the day
of the
trial,he just might go to the party instead of the trial.(If you
didn't
give him anything to remember you by).BTDT.
Some counties in NY have an ADA representing their interests, these
guy's
(M/F) will also deal,to save time,if you will plead to a reduced
charge.
"your honor, after reviewing Mr.Smith's DMV record the state is willing
to
reduce the charge to 1180a in exchange for a guilty plea".
All the "sections and paragraph's have a recomended fine.To this they
add their "surcharge" :-( So,if 1180b is speeding and 1180a is failure
to
obey a traffic device 3 vs 1 point, take it. I have even had a speeder
(1180b)
reduced to 1180,since the 1180 is the "section" and the a,b,c, are the
paragraph (the guidelines for fines are related to the paragraph)I paid
the
fine but didn't get the points. Nice old JP in Delaware County.
The system is geared for the citizen that $igns the back of the ticket
in
the "GUILTY" space and sends the fine. Those that plead "not guilty"
are in the minority and gum-up the process.
The best tool is to learn is to "work within the system",'cause it's
near
impossible to beat it.
And don't ask me how I learned about the above. Let's just say "I got
my
education first hand".
