...Seriously, there is no real risk to the passenger if there is an accident 
and the driver isnt wearing their seat belt...

I recall reading an article where MB safety people were commenting on different accident types and they stated that many people are injured or killed by objects in the car hitting someone, these objects included other people. They also mentioned that an unbelted rear seat passanger could be thrown forward and crush the person in the front seat who IS wearing their belt. Which is why I insist that anyone behind me wear a seatbelt=)
