Illegal?  Yes.  Improper or immoral?  Perhaps not.  A properly adjusted
Audi engine should have no trouble meeting emissions standards even without
a kitty.  If that is the case with a specific car then why not replace the
kitty with a "test pipe"?  Perhaps even a test pipe camouflaged to look
like a kitty.  Remember, there are places in the US where there is no such
thing as an emissions test.
