In Calif., diesels are exempt from the semi-annual smog test - so far. I think you can legally convert a gasser of any year to a diesel & if the car was subject to a smog test, I think you would take it to a smog check referee to get a permanent exemption from the smog check. I am not sure about this & before doing it myself, would check with the DMV. If the car is a 1974 or older car, no problem as they are exempt from the smog check.
As to the TDI Passet 4 Motion, it is possible that someone put a "4 Motion" emblem on a stock Passet TDI to fool the CHP to avoid putting chains on. When snowing over Donner Pass, the CHP usually requires 2 wheel drive vehicles & trucks to chain up but often exempts 4 or all wheel drive cars from doing so.
