There are several ways to deal with this, i'll mention a couple.
You could go back to correct principles of how it's "supposed to be" in
this country, but you would have to be willing to at least appeal to one
superior court. Here in PA that would be going from Magisterial Court to
the Court of Common Pleas(BTDT), and then likely to the Superior court(BTDT
too). Yes, time and money, not worth it to most to fight for due process
and correct principles. Those correct principles i'm referring to are being
able to face your accuser and have a jury trial for a *Criminal* offense.
Yes, most states classify traffic citations as criminal! Where's the
personal injury or property damage? Corpus delecti? Valid Cause of Action?
I don't think so, but being that the past few generations lost their
intestinal fortitude and have abdicated their responsibility to their
posterity, we now have much bigger issues than victimless crimes.
An argument the judge at the Magisterial level may be willing to rule on is
the fact that the officer in your situation is committing perjury. If he
was not the one that witnessed the alleged violation, you do not have a
credible fact witness testifying to the alleged violation. The officer
manning the tripod is the only one that can file a verifiable complaint,
even if it is under the Color of Law.
But then again do you even have any rights if you're not willing to fight
for them? Don't we hear about how driving is a "privilege" ? ... It's kind
of true being that you believed everyone when they told you that you had to
get a "Driver's License" so you went out and exploited your right to
contract to receive a state sanctioned privilege.
Not picking on anyone, I have a driver's license too, even though I don't
use it, but that's because I only ever received a Color of Title for my
automobile so I can't really complain about "driving" the state's car.
After all, it must be the states property, they issued my color of title,
force me under threat, duress and coercion to keep their plates on it and
force me to contract with private insurance companies, or else they will
take it from me.
Yes. i'm being a bit cinacle, but I see the cliff fast approaching at it
quite bothers me that most of my neighbors are either asleep at the wheel
or fixated on the mirage a few feet past the cliff.
