I think the facts are clear. Good driving is really good judgment. Good
driving is recognizing when conditions
dictate appropriate speeds, safe distances and parking the ego. The
unfortunate fact here in the states is the rules will be written for the
exception, not the norm and that police have the ultimate say in what is
good judgment(this bothers me because I am older then half of these cops
and have logged more miles too). That is not to say you cannot convince
a judge that the officer made a mistake. When all else fails in Calif.
you can use the basic speed law and you can use it to win a court case.
You will need to prove that your driving was "reasonable and prudent
under current road conditions" ( I love that word, "prudent" - it
reminds me of George Bush telling all us "kids", "It wouldn't be
prudent")
