Subject: Volvo tried to BRIBE Judges to overturn the Court case!!!

Latest Update Saturday March 16 1997

Volvo wants to appeal over the court decision on the "Defective Brakes'
claimed by Mr Lim Teng Hooi. One of the reason for the Appeal is that
the are AFRAID that their customers who bought the Volvo 760GLE model
decided to sue them for not informing the public about their DEFECTIVE
BRAKES. According to the witnesses during the Court Case, the Volvo
760GLE is not the PERFECT car and do have the worst brakes for that
model. Furthermore, why the Court favored Mr. Lim's claim was because
the witnesses were experienced professional MECHANICs working with VOLVO
and Independent Garages. Should we believe the Giant Car Manufacturer or
the individuals? There was also rumours that the folks at VOLVO tried
to BRIBE the Judges and the respective people in the Court. Looks like
the failed the first time, which is why that this message is important
for the public to know that the VOLVO will not have the 2nd Chance of
trying to successfully BRIBE anyone..

favoured Mr Lim's claim.

PRESS RELEASE: MR LIM Versus VOLVO, Federal Auto, Kuala Lumpur,Malaysia

Car buyer wins 'defective brakes' suit

By Lee Yuk Peng

KUALA LUMPUR: The Sessions Court has ordered Federal Auto Holdings Bhd
and a finance
company to refund a car buyer his deposit and instalments after his
Volvo 760GLE, touted to
have a superior braking system, proved defective.

On Thursday, Sessions Judge Hasnah Datuk Mohd Hashim ordered Federal
Auto Holdings
Bhd and Arab-Malaysian Finance Bhd to refund Lim Teng Hooi the
RM23,492.38 deposit,
instalments amounting to RM20,660 and the RM883.80 he had paid for
repairs after a collision.

Hasnah, however, did not allow Lim's claim for the cost of installing
the sunshade in his car.

She dismissed Arab-Malaysian Finance's counter-claim with costs and
ordered Federal Auto to bear Lim's costs.

In his statement of claim, filed 11 years ago, Lim said that in August
1985, he bought a Volvo
760GLE priced at RM83,492.38 from Federal Auto and paid RM23,492.38 as
deposit.

Lim, a chartered quantity surveyor, said the salesman at Federal Auto
told him the Volvo had
various safety features, in particular a superior brake system.

He said he was given a brochure which described the "triangular split,
dual-circuit braking
 system."

However, after buying the car, he discovered that the brake system was
defective and
dangerous as it was not sufficiently effective to slow down or stop the
car.

Despite sending the car to Federal Auto's workshops on 13 occasions, the
company failed or
neglected to rectify the defective brake system in accordance with the
terms of the Volvo
international warranty.

Lim said he was involved in a minor collision because of the defective
brakes.

On Aug 29, 1986, he finally returned the car to Arab-Malaysian Finance,
with which he had
signed the hire purchase agreement.

In its statement of defence, the finance company said the car was with
Lim for 11 months and
during the period, the car was roadworthy, fit and safe to be used.

It said if Lim was involved in an accident, it was caused by Lim's
negligence.

Federal Auto, in its statement of defence, said the Volvo 760GLE had
various safety measures,
in particular a superior brake system.

It denied that the brake system was defective, but admitted that Lim's
car was sent to its
workshops on seven occasions for checking, among others, the brakes.
