crankcase overfilling

Don't think "static", think "dynamic".  Like a heavy swell in an ocean - every 
now and then a piston will meet a large oil mass.  If the sump were full enough 
for every piston to meet the surface every time, the engine probably wouldn't 
even turn.
 
The froth is a real issue, but not as serious as "slap".  If you've ever driven 
a car like this, you'll know how suddent the power loss is - it's like hitting 
an ur-quattro fuel pump cut-out that doesn't reset itself for five to ten 
seconds.
