The other guy's insurance doesn't owe you a dime, anything they do is 
gratitous.  The other person (who caused the wreck) is who owes you money. 
 His insurance company doesn't have to pay unless a court directs them to. 
 Incidentally if you have to sue to collect, you don't sue the insurance 
company, you sue the person who caused the wreck.

Now it is true that the other person's insurance will frequently settle up 
to avoid court (where nobody knows what will happen), but they are under 
absolutely no obligation to do so, so if your demands become too 
unreasonable, then they will simply say, "Sue the guy"

Remember though that if you collect under your policy, you will have to pay 
the deductable, and you won't recover it unless your company successfully 
100% subrogates against the wreck causer's insurance company.

In my not my fault wrecks, every time the adjustor looked at my car, 
whipped out the checkbook and wrote me what I thought was a very generous 
check (frequently more than I had paid for the car).  My former Coupe GT 
was free (with only a slightly pushed in fender, bumper,  and broken side 
marker light.)
